Mindful Fitness

1. Definitions:
1.1 The Club: Mindful Fitness Ely.

2. Use of facilities

You will only be permitted to use the Club facilities provided your membership is current and fully paid up or you have made payment arrangements acceptable to the Club.

3. Suspension of Membership
A Member may, if he/she is unable to make use of the Club facilities by reason of illness or injury, suspend his/her membership for one continuous period of at least 1 month and a maximum of 3 months. 30 days notice must be given to the Club by email to hello@mindful-fitness.co.uk.

4. Fees

The Club will set the level of fees and will review such fees periodically. The Club reserves the right to change the level of fees from time to time, but guarantees that any change will be communicated at least 30 days in advance.

5. Termination:
5.1 Termination by the Club

We may terminate this agreement in the following circumstances:
(a) if you commit a serious or repeated breach of this agreement and the breach, if capable of remedy, is not remedied within 7 days of receipt of a default notice;
(b) If any part of your membership fee remains unpaid 30 days after its due date for payment, or
(c) If you provide us with details which you know to be false when applying for membership and the false declaration would have reasonably affected our decision to grant you membership.If we terminate for any of these reasons, we reserve the right to retain a proportion of the money paid under this agreement, to cover any reasonable costs incurred.

5.2 Termination by you
You may terminate your membership by giving the Club at least one full calendar month’s notice by email to hello@mindful-fitness.co.uk, so that your membership will terminate at the end of the following calendar month after notice was given.

6. Sale of Club:
In the event of the sale or disposal of the Club to another company or to any other person we may transfer your membership to the new owner and you will continue as a member of the Club and continue to pay your membership fees provided no changes to these terms or the Club rules having a material adverse effect on your use of the Club are made by the new owner. Any such disposal will not affect your contractual or statutory rights.

7. Working with us
By taking a subscription with us, you agree to the 'Working out with Mindful Fitness' conditions and you agree to comply with them.

Working out with Mindful Fitness

 

1. Acknowledgement of Risk

The participant (the "Client") acknowledges that participation in outdoor fitness activities—including but not limited to bodyweight exercises, circuit training, running, and the use of portable equipment—carries inherent risks. These include, but are not limited to, physical injury, psychological distress, pain, temporary or permanent disability, and death. These risks may arise from the Client’s own actions, the actions of others, the conditions of the outdoor environment (such as uneven terrain, weather, or public spaces), or the negligence of Mindful Fitness Ely.

2. Medical Declaration and Physical Condition

The Client warrants that they are in good physical condition and have no medical reason or impairment that might prevent their participation in Mindful Fitness Ely programmes. The Client acknowledges it is their sole responsibility to consult with a General Practitioner (GP) or qualified medical professional before starting any fitness programme. If the Client’s medical condition changes at any time, they must immediately inform the instructor and cease participation if necessary.

3. Release and Indemnity

In consideration of being permitted to participate, the Client, on behalf of themselves and their heirs, executors, and administrators, hereby releases, waives, and discharges Mindful Fitness Ely, its owners, employees, independent contractors, volunteers, and suppliers (the "Released Parties") from any and all liability, claims, or causes of action arising out of ordinary negligence. This includes, without limitation, any injury or damage resulting from the use of equipment or the outdoor environment, to the fullest extent permitted by the laws of England and Wales.

4. Personal Property

Mindful Fitness Ely accepts no responsibility for the loss, theft, or damage of any personal property brought to the training sessions. This includes items left in vehicles, bags placed on the ground during exercise, or electronic devices. The Client assumes all risk of loss for their personal belongings.

5. Client Responsibilities and Conduct

The Client agrees to follow all instructions provided by Mindful Fitness Ely staff. The Client acknowledges that they have the right to "opt-out" of any exercise they feel is unsafe for their current fitness level. Mindful Fitness Ely reserves the right to terminate a session or bar a Client from participation if their conduct is deemed unsafe, harassing, or disruptive to others.

6. Use of Facilities and Outdoor Environment

The Client acknowledges that training takes place in public or outdoor spaces not owned by Mindful Fitness Ely. The Client accepts the environment "as is" and agrees that the Released Parties are not responsible for hazards inherent to the outdoors, such as slippery grass, insects, inclement weather, or interference by members of the public.

7. Image Rights and Media Release

The Client hereby grants Mindful Fitness Ely the irrevocable right to use their name, photograph, image, or video recording taken during sessions for any legitimate promotional, marketing, or commercial purpose, including social media and website content, without further compensation or approval.

8. Governing Law and Severability

This agreement shall be governed by and construed in accordance with the laws of England and Wales. If any portion of this waiver is held to be invalid or unenforceable by a court of law, the remaining portions shall remain in full force and effect. Nothing in this agreement seeks to limit or exclude liability for death or personal injury caused by the gross negligence of Mindful Fitness Ely where such exclusion is prohibited by the Consumer Rights Act 2015.
